Assessing the occupational risks to which employees are exposed and recording them in a document called the Single Occupational Risk Assessment Document (DUERP) is a regulatory requirement under the Labor Code for all companies with one or more employees. This obligation is therefore legally binding on self-employed individuals and sole proprietorships. Failure to comply with this requirement is punishable by financial penalties from the labor inspectorate. In the event of a serious workplace accident or an employee reporting an occupational illness, failure to complete this document may result in criminal prosecution of management for failing to fulfill their obligation to ensure safety and provide enhanced resources.
